Updates on the Fight for Quality Public Education in Brevard County, FL

2024-10-15 - School Board Meeting

6:00 .

10:25 Good morning and welcome to the October 15th,

10:29 2024 board meeting.

10:30 It is now in order.

10:31 Thank you for your patience.

10:32 We obviously had some backup on I-95 this morning,

10:34 which caused a slight delay in our start time,

10:35 so I apologize for that.

10:37 I’d like to welcome my fellow board members

10:38 and the public to our meeting.

10:40 Paul, roll call, please.

10:41 Ms. Wright.

10:42 Here.

10:43 Mr. Trent.

10:44 Here.

10:45 Mr. Susan.

10:46 Here.

10:47 Ms. Jenkins.

10:48 Here.

10:49 Ms. Campbell.

10:50 Here.

10:51 At this moment, the board would like to hold a moment of silence

10:52 and I invite the audience to join.

10:53 All right.

11:22 Please rise for the Pledge of Allegiance.

11:28 I pledge allegiance to the flag of the United States of America

11:32 and to the republic for which it stands, one nation under God,

11:36 indivisible, with liberty and justice for all.

11:45 All right, that will bring us to the adoption of the agenda.

11:52 Dr. Rendell.

11:53 Thank you, madam chair.

11:54 On this morning’s agenda, we have 69 action items that are

11:56 public hearing items.

12:17 There are 69 of them, so you’re going to have to bear with us.

12:20 We will go through each one of them.

12:21 The first policy is policy 0131, which is legislative policy

12:27 making.

12:28 Is there anyone present who wishes to address this item?

12:47 Mr. Susan.

12:48 Aye.

12:49 All right.

12:50 Our next policy is board policy 0147.1, travel expenses.

12:51 Is there anyone present who wishes to address this item?

12:56 Hearing none, do I hear a motion?

12:57 Move to approve.

12:58 Second.

12:59 Any discussion?

13:00 Paul, roll call, please.

13:01 Ms. Jenkins.

13:02 Aye.

13:03 Ms. Campbell.

13:04 Aye.

13:05 Ms. Wright.

13:06 Aye.

13:07 Mr. Trent.

13:08 Aye.

13:09 Mr. Susan.

13:10 Aye.

13:11 All right.

13:12 Our next policy is board policy 0147.1, travel expenses.

13:13 Is there anyone present who wishes to address this item?

13:16 Yes.

13:17 Can you see me?

13:18 Yes.

13:19 Thank you.

13:20 Come on up to the microphone.

13:21 Yes.

13:22 Thank you so much.

13:23 I didn’t realize that there were an opportunity to do public

13:28 comments today, so I’m not really

13:30 quite that prepared, but here’s what I shared with you at my

13:34 last comment, and again, thank

13:36 you board and Dr. Rendell for allowing us to share.

13:40 In my experience as an operations manager, I value my employees’

13:47 feedback and my employees’

13:50 input, and one of the things I will hope this board will

13:54 consider is during your meeting

13:56 process when a community partner shares an idea that there’s a

14:03 closed loop system, and

14:06 some ideas may not be all good ideas, but some ideas could be an

14:10 idea that will help

14:11 improve your processes or even improve your actual operations.

14:17 So I’m hoping the board will consider during your public

14:21 comments those input that you

14:23 get from the public that the public do receive some feedback on

14:27 those items, because you

14:29 have a lot of people, and I’m going to say myself, as well as

14:34 other community partners

14:36 spend a lot of time analyzing processes, looking at procedures,

14:41 looking at what they have experienced

14:44 in their lifetime that they want to feed back to the board, and

14:48 the community wants to know

14:50 that the board is listening, and the only way we get that

14:54 feedback is through the board,

14:56 through some type of closed loop system.

15:01 So we will ask you if you will consider those items that you

15:05 think that are important to

15:07 your operation, that you provide that person some type of

15:12 feedback on their ideas.

15:14 Like I said, all ideas may not be beneficial to your vision, but

15:19 some of those could be

15:20 beneficial to your operation, because I believe that the voice

15:26 of the people is so important

15:29 to their support of you and for their support of the children

15:33 that they represent.

15:35 So if you will consider in your procedure to add a closed loop

15:40 process where someone

15:42 who took the time to stand before you to share ideas to you,

15:46 that you will provide some type

15:49 of feedback to them.

15:50 Thank you very much.

15:52 Thank you, Mr. Bryan.

15:54 All right.

15:56 Do I hear a motion?

15:57 Move to approve.

15:58 Is there a second?

15:59 Second.

16:00 Okay.

16:01 Any discussion?

16:02 I just want to say, for Mr. Bryan, there’s been several ideas

16:05 that you have personally

16:07 brought before us to the board, and I am trying to get better at

16:09 this.

16:09 I am taking your advice on just saying, hey, I want to make you

16:12 aware of certain things

16:14 that maybe you aren’t aware of whenever a comment comes before,

16:17 but I appreciate your

16:18 feedback and the fact that we definitely can do better on

16:20 communicating, so I will continually

16:21 try to improve that process.

16:25 Any other discussion?

16:26 Roll call, please.

16:27 Ms. Campbell.

16:28 Aye.

16:29 Ms. Wright.

16:30 Aye.

16:31 Mr. Trent.

16:32 Aye.

16:33 Mr. Susan.

16:34 Aye.

16:35 All right.

16:36 We are on to board policy 0169.1, public participation at board

16:38 meetings.

16:38 Is there anyone present who wishes to discuss this item?

16:40 All right.

16:41 Looks like we have someone coming forward.

16:44 Good morning, board.

16:45 Thank you for the opportunity to provide public feedback on

16:48 these proposed policy changes.

16:49 Again, I want to reiterate that I think the inclusion of

16:54 irrelevant comments is a dangerous

16:57 precedent.

17:00 I think we’ve all seen the chaos that has happened at the county

17:05 commission board meetings

17:07 using a similar policy.

17:10 I think it quiets free speech and public input and public

17:16 comment.

17:17 I just hope this board doesn’t abuse this particular part of the

17:23 policy.

17:24 Thank you.

17:29 Is there anyone else present who wishes to address this item?

17:31 Seeing none, do I hear a motion?

17:34 Move to approve.

17:35 Second.

17:36 Any discussion?

17:37 No?

17:38 No discussion?

17:40 OK.

17:41 All right.

17:42 Paul, roll call, please.

17:43 Ms. Campbell?

17:44 Aye.

17:45 Ms. Wright?

17:46 Aye.

17:47 Mr. Trent?

17:48 Aye.

17:49 Mr. Susan?

17:50 Aye.

17:51 All right.

17:52 We are on to board policy 1242, professional development, which

17:53 is being rescinded.

17:53 Is there anyone present who wishes to discuss this item?

17:58 Seeing none, do I hear a motion?

17:59 Move to approve.

18:00 Second.

18:01 Any discussion?

18:02 Paul, roll call, please.

18:03 Ms. Jenkins?

18:04 Aye.

18:05 Ms. Campbell?

18:06 Aye.

18:07 Ms. Wright?

18:08 Aye.

18:09 Mr. Trent?

18:10 Aye.

18:11 Mr. Susan?

18:12 Aye.

18:13 All right.

18:14 We are on to board policy 2210, which is the curriculum

18:16 development.

18:17 Is there anyone present who wishes to address this item?

18:22 Seeing none, do I hear a motion?

18:25 Move to approve.

18:26 Second.

18:27 Any discussion?

18:28 No?

18:29 Paul, roll call, please.

18:30 Ms. Jenkins?

18:31 Aye.

18:32 Ms. Campbell?

18:33 Aye.

18:34 Ms. Wright?

18:35 Aye.

18:36 Mr. Trent?

18:37 Aye.

18:38 Mr. Susan?

18:39 Aye.

18:40 Anybody present who wishes to address this item?

18:41 All right.

18:42 Oops.

18:43 I didn’t realize I didn’t.

18:46 Yeah.

18:47 I’ve gone in and looked at some of the curriculum for this, and

18:57 I’ll be honest with you, I’m

18:58 kind of concerned.

19:00 Resiliency is a great characteristic.

19:02 I question whether it’s something that can be taught.

19:07 A lot of psychologists feel it’s not.

19:10 It’s something that can be brought about, but it’s not something

19:17 that you teach, and

19:18 that’s my concern with this.

19:20 I know where this came from, from the governor’s wife, resiliency

19:26 education, and I like some

19:28 of the things that are laid out in here, but this idea that resiliency

19:36 is going to fix

19:37 all the issues with this younger generation, it really paints a

19:42 picture of that the younger

19:45 generation are a bunch of quitters, and it’s simply not true.

19:47 The younger generation are simply smarter than we were at their

19:51 age.

19:52 They’re brighter, they’re more informed, and because they don’t

19:56 want to do something doesn’t

19:58 mean they’re not resilient.

19:59 It just means that maybe they’re smart enough to do the cost-benefit

20:03 analysis on it, so

20:04 I’m really concerned about this.

20:06 I’ve looked at the state curriculum materials, they’re lacking

20:13 to say the least, they’re

20:16 biased to say the worst, so I know this is coming from the state,

20:22 but I’m really concerned

20:24 about this policy.

20:25 Thank you.

20:26 -Thank you.

20:27 Is there anyone else present who wishes to address this item?

20:30 Do we hear a motion?

20:32 -Move to approve.

20:33 -Second.

20:34 -Any discussion?

20:35 -In the spirit of having a closed-loop system, I’m not going to

20:39 completely agree with Mr.

20:42 Ross, but just to present a perspective, I think, whether you

20:50 call it resiliency or whether

20:53 you call it mental health education, if you look at these

20:56 standards that are in, at least

20:57 on the policy, I know the curriculum may have changed, but a lot

21:00 of it is the same kind

21:01 of thing, and there can be a stigma, even though our young

21:04 people are constantly talking

21:06 about mental health, there can be a stigma in calling it mental

21:09 health.

21:09 In reality, mental health is something we all have.

21:13 Problems with mental health is something that not everybody has,

21:16 but most of us do, but

21:17 this idea of resiliency is, to me, is the idea that this is

21:20 something that everybody

21:21 needs regardless to prepare you, but if you look at the things,

21:25 the required instruction,

21:29 besides the prevention of suicide and alcohol and drug abuse,

21:35 the awareness of school and

21:38 community resources, those are things that were already a part

21:40 of our, like, five-and-a-half

21:41 hours that we had.

21:43 Change the label on it, we’re still talking about the same kinds

21:45 of things, and to be

21:46 quite honest, this idea of self-awareness, self-management, mentorship,

21:50 honesty, critical

21:51 thinking, grit, those kinds of things are good for all of our

21:54 students, I believe, and

21:56 I think that’s a good thing for us to support.

22:00 Just to piggyback on what you said as well, one of the bullet

22:03 points in here is the recognition

22:04 of signs and symptoms of mental health concerns, so I know that

22:07 there was a change from mental

22:08 health to resiliency, so I do believe that they kind of work

22:11 well together, and that’s

22:13 something I think every parent wants to build on their child, is

22:16 the spirit of being resilient

22:17 and being able to get back up whenever something is not going

22:20 well, so I understand your hesitation

22:22 or your concern there, but I believe every single one of these

22:24 bullet points are strong

22:25 things that we would want instilled in every citizen in our

22:30 country.

22:31 Any other discussion?

22:32 No.

22:33 Paul, roll call, please.

22:34 Ms. Jenkins.

22:35 Aye.

22:36 Ms. Campbell.

22:37 Aye.

22:38 Ms. Wright.

22:39 Aye.

22:40 Mr. Trent.

22:41 Aye.

22:42 Mr. Susan.

22:43 Aye.

22:44 All right, we are on to Board Policy 2260, non-discrimination

22:44 and access to equal educational

22:45 opportunity.

22:46 Is there anyone present who wishes to address this item?

22:50 All right, seeing none, do I hear a motion?

22:53 Move to approve.

22:54 Second.

22:55 Any discussion?

22:56 Paul, roll call.

22:57 Ms. Jenkins.

22:58 Aye.

22:59 Ms. Campbell.

23:00 Aye.

23:01 Ms. Wright.

23:02 Aye.

23:03 Mr. Trent.

23:04 Aye.

23:05 Mr. Susan.

23:06 Aye.

23:07 All right, we are on to Board Policy 2266, which is non-discrimination

23:08 on the basis of

23:08 sex and education programs and activities.

23:09 Is there anyone present who wishes to address this item?

23:15 No.

23:16 All right, do I hear a motion?

23:18 Move to approve.

23:19 Second.

23:20 Any discussion?

23:21 Paul, roll call, please.

23:22 Ms. Jenkins.

23:23 Aye.

23:24 Ms. Campbell.

23:25 - Mr. Trent. - Aye.

23:26 - Mr. Susan. - Aye.

23:28 - All right, on to Board Policy 2271,

23:29 Articulation and Access to the Flourish College

23:32 Systems Institutions.

23:33 Is there anyone present who wishes to address this item?

23:40 Do I hear a motion? - Move to approve.

23:41 - Second. - Any discussion?

23:44 No, all right, Paul, roll call, please.

23:46 - Ms. Jenkins. - Aye.

23:47 - Ms. Campbell. - Aye.

23:48 - Ms. Wright. - Aye.

23:49 - Mr. Trent. - Aye.

23:50 - Mr. Susan. - Aye.

23:52 - All right, we are on to Board Policy 2340,

23:54 Field Trips and Other Student Travel.

23:56 Is there anyone present who wishes to address this item?

24:03 Seeing none, do I hear a motion?

24:05 - Move to approve. - Second.

24:06 - Any discussion?

24:08 I wanna make a statement about this one

24:10 because I’m, if no one else wants to,

24:12 this is something that’s been brought up to me

24:14 a couple times from people in the community.

24:16 They ask the question of why do we approve field trips

24:18 that are outside of our county,

24:20 sometimes outside of our state,

24:21 and sometimes even outside of our country.

24:24 And there’s different thoughts of opinion

24:26 on is this beneficial?

24:27 Should we be doing it?

24:28 Should we be allowing it from our district standpoint?

24:29 And I just kinda go back to the fact

24:31 that some of these opportunities would not be available

24:34 if they weren’t available through our school system.

24:36 These children may not ever get the opportunity

24:37 to go and do some of the amazing things

24:39 that they’re able to do

24:40 because they’re going with a team somewhere.

24:42 So it’s something that I know it’s not ideal,

24:45 and I understand the financial burden,

24:46 but there’s ways to overcome those hurdles.

24:48 And I’m just publicly stating that

24:49 because I know I will probably get a text message

24:51 after this board meeting on this one particular policy.

24:54 But I don’t think we should take away the opportunity

24:56 for a student to be able to travel with their team

24:58 when they’ve accomplished some kind of milestone,

25:00 which is why I support this policy.

25:02 So any other discussion?

25:05 No?

25:06 Paul, roll call, please.

25:07 - Ms. Jenkins. - Aye.

25:07 - Ms. Campbell. - Aye.

25:08 - Ms. Wright. - Aye.

25:09 - Mr. Trent. - Aye.

25:10 - Mr. Susan. - Aye.

25:12 - All right, we are on to board policy 2370,

25:14 educational options.

25:16 Is there anyone present who wishes to address this item?

25:21 No?

25:22 Do I hear a motion?

25:23 - Move to approve. - Second.

25:24 - Any discussion?

25:25 Oh, sorry, I’m jumping ahead of myself.

25:28 Oh, I did, no, I didn’t, okay, sorry.

25:30 Any discussion?

25:30 No, I apologize.

25:32 None?

25:33 All right, Paul, roll call, please.

25:34 - Ms. Jenkins. - Aye.

25:35 - Ms. Campbell. - Aye.

25:36 - Ms. Wright. - Aye.

25:37 - Mr. Trent. - Aye.

25:38 - Mr. Susan. - Aye.

25:39 - All right, we’re on to board policy 2370.01,

25:42 virtual instruction.

25:44 Is there anyone present who wishes to discuss this policy?

25:50 Seeing none, do I hear a motion?

25:52 - Move to approve. - Second.

25:53 - Any discussion?

25:55 - We’re trying to keep it easy for you, Paul.

25:57 - Paul, roll call, please.

25:59 - Ms. Jenkins. - Aye.

26:00 - Ms. Campbell. - Aye.

26:01 - Ms. Wright. - Aye.

26:02 - Mr. Trent. - Aye.

26:02 - Mr. Susan. - Aye.

26:04 - All right, on to board policy 2371, the Hope Scholarship.

26:07 Is there anyone present who wishes to discuss this item?

26:13 Seeing none, do I hear a motion?

26:15 - Move to approve. - Second.

26:16 - Any discussion?

26:18 - Poll roll call.

26:19 - Ms. Jenkins.

26:20 - Aye.

26:20 - Ms. Campbell.

26:21 - Aye.

26:22 - Ms. Wright.

26:23 - Aye.

26:24 - Mr. Trent.

26:25 - Aye.

26:25 - Mr. Susan.

26:26 - Aye.

26:27 - On to policy 2415, tutoring for credit.

26:28 Is there anyone present who wishes to address this item?

26:34 Seeing none, do I have a motion?

26:36 - Move to approve.

26:37 - Second.

26:38 - Any discussion?

26:39 Poll roll call please.

26:40 - Ms. Jenkins.

26:41 - Aye.

26:42 - Ms. Campbell.

26:43 - Aye.

26:44 - Ms. Wright.

26:44 - Aye.

26:45 - Mr. Trent.

26:46 - Aye.

26:47 - On to policy 2421, career and technical education programs.

26:50 Is there anyone present who wishes to address this item?

26:52 Okay.

26:58 - I want to speak on item 20,

27:00 armed services vocational aptitude battery, the AFSAB.

27:06 The wording that’s been added is

27:07 the district shall provide opportunities to students

27:10 in grades 11 to 12 to take the armed services

27:13 vocational aptitude battery during normal school hours

27:16 and if requested by a student,

27:18 the opportunity to consult with a military recruiter.

27:22 I’m really curious considering this board

27:24 is such a parental rights focused board,

27:30 so much to do a proclamation

27:32 that there’s not a sentence in here

27:34 that would require these students

27:36 to get parental permission

27:37 before they go talk to a military recruiter.

27:39 I find it kind of odd.

27:41 Thanks.

27:44 - All right, is there anyone else present

27:45 who wishes to address this item?

27:48 No, do I have a motion?

27:49 - Move to approve.

27:50 - Second.

27:51 - Any discussion?

27:52 Ms. Campbell’s ready to go.

27:53 I see your finger on the button.

27:53 - I do, I do.

27:55 Dr. Rendell, I believe at the beginning of the year

27:57 when we do our registration process

27:58 that parents are required

27:59 as part of their directory information form

28:02 to mark whether or not they want their information,

28:05 their child’s information to go to military recruiters.

28:07 Am I correct on that?

28:08 - That is correct.

28:09 - Should that cover the ability for them

28:11 to reach out to, or this is the student going to them,

28:13 not them going to the student.

28:14 - No, theoretically that’s just providing

28:16 the directory information to the recruiter.

28:18 If a student went to their guidance counselor

28:20 and said I’d like to talk to a military recruiter,

28:21 then we would facilitate that.

28:24 More than likely they would still call home

28:25 just to make sure this is something

28:27 that the family’s in favor of.

28:29 - Gotcha, thank you.

28:32 - All right, any other discussion?

28:33 - Yeah, so I have a follow up to that.

28:34 So I hear what you’re saying,

28:37 but more than likely is not a secure policy that’s in place.

28:42 So I do think it’s important for it to be addressed.

28:45 I don’t think it should delay this,

28:47 but I think it’s important to be addressed.

28:50 Because if we’re gonna require parental permission slips

28:53 for things like, you know, NEOs born and Band-Aids,

28:57 I think we should have parental permission

28:58 for something like this.

29:00 And not even just for a negative thing

29:02 or for them to stop their kid from doing it,

29:04 but the parent has a right to know

29:05 and they can even support their child

29:06 through that process, right?

29:08 And help them make decisions through that process.

29:10 So I think it’s important that we do put it in place

29:13 just to avoid any issues in the future.

29:17 - As a follow up, and I agree,

29:19 I think we need to move this forward,

29:21 but can we ask Ms. Harris or whoever under her department

29:27 would be able to give us the language, the statute language,

29:30 because if this is kind of a transliteration

29:33 from the statute, we wanna make sure we’re matching.

29:35 And I don’t actually, I’m trying to remember

29:37 if this is a federal law or a state law update.

29:41 But if they can send that to us,

29:43 I think that would be helpful to me at least.

29:45 - Yep, we can do that.

29:46 - Absolutely.

29:47 All right, any other discussion?

29:50 Hearing none, Paul, roll call, please.

29:52 - Ms. Jenkins. - Aye.

29:53 - Ms. Campbell. - Aye.

29:54 - Ms. Wright. - Aye.

29:55 - Mr. Trent. - Aye.

29:55 - Mr. Susan. - Aye.

29:57 - All right, we are on to Board Policy 2423,

30:00 School to Work Program.

30:01 Is there anyone present who wishes to address this item?

30:08 Hearing none, do I hear a motion?

30:09 - Move to approve. - Second.

30:10 - Any discussion?

30:12 Paul, roll call, please.

30:13 - Ms. Jenkins. - Aye.

30:14 - Ms. Campbell. - Aye.

30:15 - Ms. Wright. - Aye.

30:16 - Mr. Trent. - Aye.

30:17 - Mr. Susan. - Aye.

30:18 - All right, on to Board Policy 2432, Driver Education.

30:22 Is there anyone present who wishes to address this item?

30:28 Seeing none, do I hear a motion?

30:30 - Move to approve. - Second.

30:31 - Any discussion?

30:32 Nope, Paul, roll call, please.

30:34 - Ms. Jenkins. - Aye.

30:35 - Ms. Campbell. - Aye.

30:35 - Ms. Wright. - Aye.

30:36 - Mr. Trent. - Aye.

30:37 - Mr. Susan. - Aye.

30:39 - All right, on to Board Policy 2440, Summer School.

30:41 Is there anyone present who wishes to address this item?

30:47 Seeing none, do I hear a motion?

30:49 - Move to approve. - Second.

30:50 - Any discussion?

30:52 Paul, roll call, please.

30:53 - Ms. Jenkins. - Aye.

30:54 - Ms. Campbell. - Aye.

30:55 - Ms. Wright. - Aye.

30:56 - Mr. Trent. - Aye.

30:57 - Mr. Susan. - Aye.

30:58 - On to Board Policy 2455, Dropout Prevention

31:01 and Academic Intervention Programs.

31:03 Is there anyone present who wishes to address this item?

31:09 Hearing none, do I have a motion?

31:12 - Move to approve. - Second.

31:13 - Any discussion?

31:15 Paul, roll call, please.

31:16 - Ms. Jenkins. - Aye.

31:17 - Ms. Campbell. - Aye.

31:18 - Ms. Wright. - Aye.

31:19 - Mr. Trent. - Aye.

31:20 - Mr. Susan. - Aye.

31:22 - All right, on to Board Policy 2460,

31:24 Exceptional Student Education.

31:25 Is there anyone present who wishes to address this policy?

31:31 Seeing none, do I have a motion?

31:33 - Move to approve. - Second.

31:34 - Any discussion?

31:36 Paul, roll call, please.

31:37 - Ms. Jenkins. - Aye.

31:38 - Ms. Campbell. - Aye.

31:39 - Ms. Wright. - Aye.

31:40 - Mr. Trent. - Aye.

31:41 - Mr. Susan. - Aye.

31:42 - All right, on to board policy 2520,

31:44 selection and adoption of instructional materials.

31:46 Is there anyone present who wishes to address this item?

31:52 Seeing none, do I have a motion?

31:53 - Move to approve. - Second.

31:55 - Any discussion?

31:57 Paul, roll call, please.

31:58 - Ms. Jenkins. - Aye.

31:59 - Ms. Campbell. - Aye.

32:00 - Ms. Wright. - Aye.

32:01 - Mr. Trent. - Aye.

32:02 - Mr. Susan. - Aye.

32:03 - On to board policy 2521, instructional materials program.

32:06 Is there anyone present who wishes to address this item?

32:08 All right.

32:14 - Yeah, I wanna address item F,

32:16 replacement and purchase of instructional materials

32:19 by students/parents.

32:22 The policy reads students may be held responsible

32:25 for the cost of replacing any instructional materials

32:27 lost, destroyed, or unnecessarily damaged,

32:30 failure to provide payment for the damage or loss

32:32 may result in the suspension of the student

32:34 from participation in extracurricular activities

32:38 or the debt may be satisfied

32:39 by the student performing community services activities

32:42 at the school site,

32:44 such as determined by the school principal.

32:47 A student or his or her parents may purchase a copy

32:49 of the designated course instructional materials

32:51 regardless of format for the district’s purchase price,

32:55 including shipping, plus 10%.

32:58 I have to say I find this policy to be rather

33:04 inequitable, kind of rude considering we have 60%

33:08 of our kids here in BPS are on free or reduced lunch.

33:14 I feel the additional 10% on top of replacing the materials

33:17 is unnecessary, understanding that sure,

33:23 instructional materials do get lost or damaged.

33:28 I feel that’s just the price of doing business, right?

33:33 That to hold students in a county such as Brevard

33:38 responsible for this and hold their parents,

33:40 many of whom are holding two jobs each

33:44 just to provide food and rent,

33:47 I think just this is the wrong time

33:49 to implement this kind of policy.

33:54 It’s very blind to what’s going on in the economy right now.

33:58 Thank you.

34:01 - All right, is there anyone else present

34:03 who wishes to address this item?

34:06 Do I have a motion?

34:07 - Move to approve. - Second.

34:08 - Any discussion? - Yep.

34:10 - You were quick on that button.

34:11 - I am, I am, that’s my visual signal to you.

34:14 I want to say something.

34:16 Appreciate the feedback.

34:17 Actually this language was in the previous policy

34:20 that we just approved was removed and moved into this policy

34:22 and the strategic change is may instead of shall

34:26 and that gives schools the flexibility to–

34:28 - Correct.

34:29 - Take care of that very thing that you just addressed.

34:30 - Absolutely. - Yes.

34:32 - Sorry, I beat you to it, Dr. Endau.

34:34 - All right, anyone else, any other discussions?

34:38 Paul, roll call please.

34:39 - Ms. Jenkins. - Aye.

34:40 - Ms. Campbell. - Aye.

34:41 - Ms. Wright. - Aye.

34:42 - Mr. Trent. - Aye.

34:43 - Mr. Susan. - Aye.

34:44 - All right, on to board policy 2522,

34:46 challenges to adoption or use of instructional library

34:51 or reading list materials.

34:52 Is there anyone present who wishes to address this item?

34:55 - I figured you, we would have someone, all right,

34:58 thank you, you’re good to go.

35:00 - I want to address item H, parents shall have the right

35:04 to read passages from any materials

35:06 as subject to an objection.

35:07 If the board denies a parent the right to read passages

35:10 due to content that is subject to an objection

35:13 on the basis that is pornographic or prohibited,

35:16 blah, blah, blah, blah, right?

35:17 They can remove the book from the district, the material.

35:21 I think in light of the recent court decision

35:24 in the case for moms for Liberty Suit Brevard School Board,

35:33 I know that’s been kicked back down to the lower court,

35:35 but the appellate court did say that they really had issues

35:40 with this particular part of the policy.

35:42 I think it would be smart of this board

35:44 to remove this part of the policy and address this.

35:51 This may not be the time,

35:52 but this is certainly going to be problematic

35:55 I think moving forward,

35:56 or parents come up here to do this, right?

35:58 The court basically said that parents have a right

36:01 to come up here and read material that is not obscene.

36:05 And if you stop them, that’s a first amendment violation.

36:07 So, and considering that none of the material

36:11 that’s been read and removed by this board

36:15 from people who read at the podium here,

36:19 none of it was pornographic, none of it was obscene,

36:22 but you stopped them from reading it.

36:25 So I think you really need to revisit this part of policy

36:30 or it’s gonna cost taxpayers money.

36:31 Thank you.

36:33 - Thank you, Mr. Ross.

36:35 Is there anyone else present who wishes

36:36 to discuss this item?

36:38 Do I have a motion?

36:39 - Move to approve.

36:41 - Second.

36:41 - Any discussion?

36:43 - No, sorry, I can’t do everything.

36:45 - No, no.

36:47 All right, no other discussion.

36:49 Paul, roll call, please.

36:50 - Ms. Jenkins.

36:51 - Aye.

36:51 - Ms. Campbell.

36:52 - Aye.

36:53 - Ms. Wright.

36:54 - Aye.

36:55 - Mr. Trent.

36:56 - Aye.

36:56 - Mr. Susan.

36:57 - Aye.

36:58 - All right, on to more policy.

36:59 - If I could just go back.

37:00 You asked for the statutory language on the ASVAB stuff.

37:01 It is Florida Statute 1003.451 sub four,

37:06 and it says that we are required to provide students

37:09 in grades 11 and 12 the opportunity

37:11 to consult with military recruiters.

37:13 So the language is taken straight from statute.

37:15 - From Florida Statute?

37:16 - Florida Statute.

37:17 - Okay.

37:18 - Okay, thank you.

37:19 - Thank you.

37:20 All right, on to board policy 2540, audio visual use.

37:25 Is there anyone present who wishes to discuss

37:27 or address this item?

37:28 Is there anyone present who wishes to address this item?

37:30 Seeing none, do I have a motion?

37:32 - Move to approve. - Second.

37:33 - Do I have any discussion from the board?

37:35 Paul, roll call please.

37:36 - Miss Jenkins. - Aye.

37:37 - Miss Campbell. - Aye.

37:38 - Miss Wright. - Aye.

37:39 - Mr. Trent. - Aye.

37:40 - Mr. Seuss. - Aye.

37:42 - On to board policy 2575, service learning.

37:44 Is there anyone present who wishes to address this item?

37:50 Seeing none, do I have a motion?

37:52 - Move to approve. - Second.

37:53 - Any discussion?

37:55 Paul, roll call please.

37:56 - Miss Jenkins. - Aye.

37:57 - Miss Campbell. - Aye.

37:58 - Miss Wright. - Aye.

37:58 - Mr. Trent. - Aye.

37:59 - Mr. Seuss. - Aye.

38:01 - On to board policy 3121.01,

38:04 criminal background and employment history checks.

38:06 Is there anyone present who wishes to address this item?

38:14 - Yeah, I want to talk about the addition to this policy

38:17 where it states that any failure by the applicant

38:23 to accurately disclose criminal arrest history

38:25 shall automatically disqualify the applicant

38:27 from being considered for employment for a period of one

38:30 calendar year from the date of background screening.

38:34 And then the addition is candidates disqualified

38:37 for employment due to non-disclosure of criminal

38:39 arrest history may submit an appeal to the superintendent

38:43 or designee.

38:45 First off, we all know why this particular change has

38:48 come about, right?

38:49 We have school board members who failed to do that.

38:54 Looking at you, Mr. Susan, looking at you, Mr. Trent.

38:58 On top of that, we had school board members

39:00 that then went out and actively pointed out other teachers that

39:06 had this happen to them.

39:08 So we all know why this is in here,

39:09 though neither one of you may need this at this point.

39:13 I will point out that this board claims to be,

39:17 let’s run schools like a business, right?

39:20 There is no business that I have ever

39:22 worked for that has some kind of lame appeal process like this.

39:27 You lie in your application to be an employer,

39:30 to be an employee, you’re disqualified from that job,

39:34 right?

39:36 I see no reason to do this.

39:38 There’s nobody out there who does this, right?

39:42 It’s a nice thing, sure, but it’s unnecessary.

39:44 I don’t care who did it.

39:46 It’s very plain on the language when you sign up.

39:50 What qualifies, to report, OK?

39:55 If you don’t report it, you shouldn’t have been hired.

39:57 It’s that simple.

39:58 Thank you.

40:01 All right.

40:01 Is there anyone else present who wishes to address this item?

40:05 No?

40:06 All right.

40:07 Do I have a motion?

40:09 Move to approve.

40:09 Second.

40:10 Any discussion?

40:14 All right, Paul, roll call, please.

40:15 Ms. Jenkins?

40:15 Aye.

40:16 Ms. Campbell?

40:16 Aye.

40:17 Ms. Wright?

40:18 Aye.

40:18 Mr. Trent?

40:19 Aye.

40:19 Mr. Susan?

40:20 Aye.

40:20 All right.

40:21 On to board policy 5114, foreign students.

40:23 Is there anyone present who wishes to address this item?

40:31 Yeah, I want to address on this, the two additions that

40:35 says non-immigrant students with J1 visas.

40:39 And it looks like the addition is

40:41 students may not graduate from high school

40:42 or receive a diploma.

40:43 I’m not sure where this is coming from.

40:45 Maybe it’s coming from statute.

40:47 You guys are forced to do this.

40:49 You put the same addition into non-immigrant students

40:52 with F1 visas.

40:53 Those students may not graduate from high school

40:56 or receive a diploma.

40:59 I really don’t see how this adds to public education.

41:04 This seems to take away.

41:07 The Florida Constitution does not define–

41:15 it’s any resident of Florida is subject to an education.

41:22 This goes against the Florida Constitution.

41:25 I find it just crazy to think that students

41:29 can put in all this time.

41:30 And just because they have J1 visas or F1 visas,

41:34 they may not graduate from high school or receive a diploma.

41:36 Understanding I may not know all the facts,

41:38 there may be statutes or regulations that require this.

41:41 If so, those are wrong.

41:43 And the board should say so.

41:45 Thank you.

41:48 Is there anyone else present who wishes to address this item?

41:52 No.

41:53 I’m trying to find the email.

41:54 Ms. Harris, I know I’m going to put you on the spot

41:55 right now.

41:56 Because this is a question I had as well.

41:58 And I’m just going to ask you, if you

41:59 don’t mind coming forward just to clarify this.

42:01 I’m trying to find the email and I

42:02 can’t put my hands on it, on the reason being for it.

42:06 I asked that exact same question, Mr. Ross,

42:08 because I was concerned as well.

42:11 Yeah, I think it has more to do with that our foreign exchange

42:14 are usually only here for a year and that doesn’t give them

42:16 enough time to complete all of the graduation

42:18 requirements for the state of Florida or US.

42:22 That is exactly the–

42:24 this is for a foreign exchange student.

42:26 So this is not for a family that moves to the United States

42:29 from out of the country that just happens

42:32 to enroll as an 11th grader.

42:34 This would be for our foreign exchange students.

42:37 And we have really looked into this of is this,

42:42 do we have wiggle room within this?

42:43 And speaking with other districts on their practices.

42:46 And there really is not an option

42:49 just because they can’t meet all the requirements for graduation.

42:53 Even we were trying to work with some specific families

42:57 where the family just wanted them to stay another year

42:59 and live with the exchange family.

43:03 And we just can’t do that.

43:06 So I can look up the language right now

43:08 and I can get you some further clarification.

43:10 I know you sent me an email.

43:11 Sorry to put you on the spot.

43:12 I know you sent me an email because I’d

43:13 asked this exact question.

43:14 And I, for whatever reason, because we’ve

43:16 been working on these since really September.

43:19 I just want to be clear.

43:20 So if we have just the family moves here and they enroll,

43:24 that’s a different situation.

43:25 This is specific to foreign exchange students.

43:28 OK, thank you.

43:29 Thank you for the clarification.

43:32 Any other discussion from the board?

43:33 We need a motion and a second.

43:35 Oh, we don’t have a motion and a second.

43:36 Sorry.

43:37 Do we have a motion?

43:37 Move to approve.

43:38 Do we have a second?

43:39 Second.

43:40 All right, any discussion from the board?

43:42 No?

43:43 Paul, roll call, please.

43:44 Ms. Jenkins?

43:44 Aye.

43:45 Ms. Campbell?

43:45 Aye.

43:45 Ms. Wright?

43:46 Aye.

43:47 Mr. Trent?

43:47 Aye.

43:48 Mr. Susan?

43:48 Aye.

43:49 All right.

43:49 We’re on to board policy 5130, withdrawal from school.

43:52 Is there anyone present who wishes to address this item?

43:57 Seeing none, do I have a motion?

43:59 Move to approve.

44:00 Second.

44:01 Any discussion?

44:03 Paul, roll call, please.

44:07 Aye.

44:08 Mr. Susan?

44:08 Aye.

44:09 All right.

44:10 We’re on to board policy 5330.01, self-administered medication

44:14 and use of an EpiPen.

44:16 Is there anyone present who wishes to address this item?

44:49 Ms. Wright?

44:50 Aye.

44:50 Mr. Trent?

44:51 Aye.

44:51 Mr. Susan?

44:52 Aye.

44:52 All right.

44:53 On to board policy 5410.01, promotion, placement, and retention.

44:58 Is there anyone present who wishes to address this item?

45:03 Do I hear a motion?

45:05 Move to approve.

45:06 Second.

45:07 Any discussion?

45:08 Paul, roll call, please.

45:10 Ms. Jenkins?

45:11 Aye.

45:13 Aye.

45:14 Ms. Wright?

45:15 Aye.

45:16 Mr. Trent?

45:17 Aye.

45:18 Mr. Susan?

45:19 Aye.

45:20 On to board policy 5420, reporting student progress.

45:21 Is there anyone present who wishes to address this item?

45:24 Move to approve.

45:25 Second.

45:28 Ms. Jenkins?

45:29 Aye.

45:30 Ms. Campbell?

45:35 Aye.

45:36 Mr. Susan?

45:37 Aye.

45:38 All right.

45:39 On to board policy 5463, credits from other schools.

45:40 Is there anyone present who wishes to address this item?

46:03 Seeing none, do I have a motion?

46:05 Move to approve.

46:16 Mr. Trent?

46:17 Aye.

46:18 Mr. Susan?

46:19 Aye.

46:20 All right.

46:21 On to board policy 5465, general education development, your GED

46:22 test.

46:22 Is there anyone present who wishes to address this item?

46:25 Seeing none, do I have a motion?

46:28 Move to approve.

46:29 Second.

46:30 Any discussion?

46:31 Paul, roll call.

46:32 Ms. Jenkins?

46:33 Aye.

46:34 Ms. Campbell?

46:35 Aye.

46:36 Ms. Wright?

46:37 Aye.

46:38 Mr. Trent?

46:39 Aye.

46:40 Mr. Susan?

46:41 Aye.

46:42 All right.

46:43 Board policy 5505, academic honesty, is there anyone present who

46:44 wishes to address this

46:44 item?

46:45 All right.

46:46 Yeah, I’d like to address item C, utilizing artificial

46:56 intelligence platforms and natural

46:58 language processing tools to create content and then submitting

47:01 the content as one’s own.

47:02 While I appreciate the board is trying to get ahead of this, I

47:06 think you’re – and you

47:07 do address it more in policy 7540, I think you guys are not

47:12 getting far enough ahead

47:14 of this in that within a year or two, and it’s really already

47:21 here, a lot of AI is already

47:24 going to be embedded in the very tools you use.

47:27 You’re going to have a watch, it’s going to have AI in it, you’re

47:30 going to have a calculator,

47:31 it’s going to have AI in it.

47:35 Microsoft Word already has AI capabilities in it, and my concern

47:41 is that, one, if the

47:43 district doesn’t become highly educated on this very quickly,

47:46 teachers aren’t going to

47:48 know when a kid uses AI.

47:50 The kids, the students aren’t even going to know when they’re

47:53 using AI capabilities, especially

47:55 natural language processing capabilities.

47:57 So while I appreciate that you’re trying to deal with this, I

48:04 feel this policy, very much

48:06 kind of like your cell phone policy, is behind the times.

48:11 You’re not going to stop this technology, it’s coming, it’s

48:14 going to be on the kids,

48:16 it’s going to be in everything, every tool, electronic tool that

48:19 they use in a very short

48:20 amount of time, and I really think you need to write better

48:26 policy about this.

48:28 It needs to be more specific and have some real clarification in

48:34 there about what is

48:36 or what isn’t allowed.

48:39 That may be hard to do, but this policy is going to be out of

48:43 date in six months, maybe

48:45 a year.

48:47 And I will come back here and address policy 7540 as well as I

48:50 have some other concerns

48:52 about that.

48:53 Thank you.

48:54 Thank you, Mr. Ross.

48:55 Is there anyone else present who wishes to address this item?

48:58 Do I have a motion?

49:01 Move to approve.

49:02 Second.

49:03 Any discussion?

49:04 I’d like to.

49:05 You would like to?

49:06 Yeah, it’s one of the items.

49:07 There’s a lot of school districts that are forming committees to

49:08 address this, both with

49:09 not only regulations but also communications to our students.

49:13 I think there’s a lot of possibilities here that I think we

49:17 should take a look at.

49:18 I got approached from about three or four other school districts,

49:21 Miami-Dade, Broward

49:22 and others that are forming like a statewide group to try to

49:25 take a look at this from school

49:27 districts’ perspective, from multiple angles.

49:29 So I think that after this policy is passed, I think it would be

49:32 advantageous for us to

49:33 form a little advisory committee to try to figure out how to

49:36 communicate to the people

49:37 – our teachers, everybody else, our parents – on how to

49:40 identify.

49:40 We’ve all received the emails recently about my kid’s been

49:44 accused of using AI, and the

49:46 parents are wondering how that process goes for the teachers,

49:49 what the limits are and

49:50 everything else.

49:51 So I think it would be advantageous for us to move in that

49:53 direction once this is passed.

49:55 So thank you.

49:56 Thank you.

49:57 Any other discussion on this one?

49:59 No?

50:00 I don’t disagree.

50:01 I think this policy is one that’s going to be revisited quite

50:04 frequently, honestly, because

50:05 technology changes so quickly, so rapidly.

50:09 And AI is an issue.

50:12 I don’t love it either.

50:13 I understand the concern that we’re hearing, and I think it

50:15 would be smart of us to really

50:17 take a deep dive on this.

50:18 I know Mr. Cheatham back there shaking his head, he’s like, “Hi,

50:20 this is my department.”

50:21 So I think it’s a good idea for us to look at how we’re going to

50:24 combat this in the future

50:25 because it is going to become an issue all over the place.

50:28 But I think for right now we need to move forward with the

50:31 policy as it is and come

50:33 back and revisit this probably multiple times, unfortunately, as

50:36 technology changes.

50:38 But on the other hand, this policy is defining terms.

50:41 It’s defining what academic dishonesty is.

50:45 And even letter C, that is academic dishonesty.

50:49 And at this point, if we don’t have the tools, it’s a matter of

50:51 do we have the tools to enforce

50:53 it, that’s a different conversation to me than this policy.

50:56 This policy is laying down the standard, here is what it is, and

51:00 gives our staff the tools

51:02 to say you violated this policy.

51:04 Now how they can determine that is going to be the challenge.

51:06 But the policy is in place because this is more and more.

51:09 And for our virtual school, our virtual schools are already

51:12 having to deal with this, and

51:13 they have their own ways of dealing with it because they know it’s

51:16 even harder when you’re

51:17 not eyes on a student.

51:19 But I think the policy is good and may need tweaking, may not,

51:24 because the application

51:26 of it doesn’t belong to the policy, it belongs in maybe

51:28 administrative procedures or what

51:29 our staff develop beyond it.

51:32 And as far as definitions go, that is academic dishonesty.

51:38 I don’t think there’s any question.

51:40 Yeah, just not that it’s completely specific to this, but just I’ve

51:44 been saying this time

51:45 and time again when we’re having a debate about cell phones in

51:47 the classroom, but I

51:48 think it’s advantageous of Brevard Public Schools to be a leader

51:53 in this state.

51:54 It’s happening around the world, it’s happening across the

51:56 country, it’s not necessarily happening

51:58 in Florida just yet.

52:01 To be forward thinking when it comes to opportunities for our

52:04 students to have classes that teach

52:06 them how to discern factual information on the internet, how to

52:11 use these tools to their

52:12 benefit but to use them with honesty and integrity, because the

52:17 reality is as much as people want

52:19 to say negative things about it, it is a positive tool, right?

52:23 And it is our job, I believe, as a school system to not shut

52:26 down the advancement of

52:27 technology for our students and to shun them out of the

52:30 classroom, but it’s our obligation

52:32 honestly because they’re with us all day long and that’s what

52:34 they’re using it for, to start

52:35 to develop classes and coursework for our students to be able to

52:39 use it appropriately.

52:40 We can’t expect them to just learn it or to understand how to

52:44 use it appropriately.

52:45 It’s our obligation, quite frankly, and we need to start in the

52:48 youngest of ages when

52:49 we have kids sitting on iPads when they’re five years old.

52:53 We need to be able to do that and that’s not going to be quick

52:56 or easy and that’s a huge

52:57 demand and task on our staff, but I think that we need to be

53:00 forward thinking and figure

53:02 out how to implement something like that within the next coming

53:04 years.

53:04 And again, it’s an opportunity to be leaders in the state.

53:08 Alright, thank you.

59:14 Aye.

59:15 On to Board Policy 7440, Buildings and Ground Security.

59:41 Is there anyone present who wishes to address this item?

59:43 All right.

59:44 Yeah, I want to address item F. It says under Florida law,

59:52 parents have the right to give

59:54 their consent in writing before a school employee makes a video

59:57 or voice recording of their

59:59 minor child unless the recording is used solely for the

1:00:03 following, with some exceptions, a

1:00:06 safety demonstration, a purpose related to a legitimate academic

1:00:09 or extracurricular activity,

1:00:11 a purpose related to a regular classroom instruction, security

1:00:15 or surveillance of buildings and

1:00:18 grounds.

1:00:19 Yeah, Mr. Ross, I think that one’s under the next policy, the

1:00:20 video surveillance and electronic

1:00:21 monitoring.

1:00:22 So I know I’m trying to find where you’re at and there’s no F on

1:00:24 this policy.

1:00:25 We’re almost there.

1:00:27 So come back.

1:00:28 We’ll be back in just a second.

1:00:29 But that’s the next one.

1:00:30 All right.

1:00:31 Is there anyone else present who wishes to address this policy,

1:00:33 which is Buildings and

1:00:33 Ground Security?

1:00:34 No?

1:00:35 All right.

1:00:36 Do I have a motion?

1:00:37 Move to approve.

1:00:38 Second.

1:00:39 Any discussion?

1:00:40 Paul, roll call, please.

1:00:41 Ms. Jenkins.

1:00:42 Aye.

1:00:43 Ms. Campbell.

1:00:44 Aye.

1:00:45 Ms. Wright.

1:00:46 Aye.

1:00:47 Mr. Tran.

1:00:48 Aye.

1:00:49 Mr. Susan.

1:00:50 Aye.

1:00:51 All right.

1:00:52 Now we’re on to 7440.01, which is video surveillance and

1:00:53 electronic monitoring.

1:00:53 Mr. Ross, you have the floor.

1:00:54 Great.

1:00:55 Thank you.

1:00:56 I’ll start over.

1:00:57 So this is item F. It’s in addition, under Florida law, parents

1:01:02 have the right to give

1:01:04 their consent in writing before a school employee makes a video

1:01:07 or voice recording of their

1:01:09 minor child unless the recording is used solely for the

1:01:11 following items, and these are exceptions,

1:01:14 right?

1:01:15 A safety demonstration, a purpose related to a legitimate

1:01:17 academic or extracurricular

1:01:19 activity, a purpose related to regular classroom instruction,

1:01:22 security or surveillance of buildings

1:01:25 or grounds, a photo ID card, or recording of IEP team meetings,

1:01:30 which is addressed in

1:01:32 a different policy.

1:01:33 So the question I have is why do we have photos and videos of

1:01:39 children that are on Matt Susan’s

1:01:42 campaign page?

1:01:46 That obviously violates policy.

1:01:48 I don’t see the exception in here, hasn’t been added in, and

1:01:53 that’s concerning.

1:01:55 So I would ask this board to please investigate why there are

1:01:59 students, pictures of students

1:02:02 and classrooms on Matt Susan’s campaign page.

1:03:23 Mr. Susan. On to board policy 7540.08 which is artificial

1:03:29 intelligence.

1:03:30 Is there anyone present who wishes to address this item? Mr.

1:03:34 Ross, you have the floor.

1:03:37 Yeah, I just want to address this kind of in general terms that

1:03:41 one of the things that people don’t talk about is that AI is

1:03:46 going to be inequitable in a lot of ways.

1:03:50 If you think about Google, and this goes to your point, Miss

1:03:54 Jenkins, about critical thinking, there’s an equity in how

1:03:58 people use a simple search engine.

1:04:01 Certain people are educated and know how to use it efficiently.

1:04:08 There are people that aren’t. This is a failure of the school

1:04:10 system, a failure of our society in general, and AI is just

1:04:14 going to compound that.

1:04:16 When you can start asking inquisitive questions, we’re already

1:04:22 seeing this in a lot of AI, is the ability to develop your

1:04:28 prompt is vital in there.

1:04:31 I would like to see this district get ahead of that, going very

1:04:36 much to what Miss Jenkins talked about, is learning how to use

1:04:41 these tools instead of just being kind of stand back and watch

1:04:46 and see what happens with them.

1:04:49 I’d like to see this school district work on ensuring that all

1:04:56 students will be able to use AI equitably. It is definitely

1:05:02 going to be compounded.

1:05:04 We already see how misinformation is spread on the internet, and

1:05:09 people are going to need to have critical thinking skills and

1:05:14 know how to use AI properly, and that should be addressed in

1:05:18 this policy. Thank you.

1:05:22 - Thank you, is there, oh, I might turn off.

1:09:45 Oh, I saw this just a little while ago.

1:09:49 Last week on the 8th, 9th, and 10th,

1:09:51 the district was supposed to be doing,

1:09:53 having the three meetings for the science,

1:09:56 instructional materials adoption

1:09:57 and the personal finance materials adoption

1:09:59 and I just noticed today they’ve rescheduled that

1:10:02 for tomorrow, so for anybody who may be watching,

1:10:05 tomorrow night, which is Wednesday,

1:10:08 on the, what’s the date, the 17th,

1:10:12 from five p.m. to seven p.m. at Viera Middle School.

1:10:15 If anyone is interested in attending those events,

1:10:17 they all got canceled last week.

1:10:19 That’ll be for the science instructional materials

1:10:21 and the personal finance instructional materials.

1:10:23 I just thought I’d do a little public announcement.

1:10:26 Is that, that’ll just be the one date.

1:10:29 - It’s the 16th.

1:10:30 - It’s the 16th, sorry.

1:10:33 I’m trying to move faster through the week

1:10:35 than, you know, it’s going, so, yes.

1:10:37 - Everyone has hurricane brain and what day is it?

1:10:39 - Wednesday night, the 16th from five to seven,

1:10:42 next door at Viera Middle School.

1:10:44 All are welcome to come and take a look at those materials

1:10:46 and then you’ll have the opportunity

1:10:48 to provide input and ask questions.

1:10:51 - Thank you, Ms. Campbell, for reminding the public of that.

1:10:53 Any other further things to report or discuss?

1:10:56 All right, Mr. Gibbs, there is a request

1:10:58 for a client attorney session,

1:11:00 so the chair recognizes the board attorney, Mr. Gibbs.

1:11:02 - Board members, on behalf of attorney Howard Marks,

1:11:05 I am notifying you that advice is needed

1:11:07 regarding the pending litigation style Moms for Liberty,

1:11:09 et al. v. the School Board of Brevard County, Florida,

1:11:12 et al. case number six colon 21-CV-01849,

1:11:17 11th Circuit case number 23-10656.

1:11:22 Pursuant to 286-011 Florida statutes

1:11:24 known as the Government in the Sunshine Act,

1:11:26 I am requesting an attorney client session with the board

1:11:29 for the purpose of discussing strategy

1:11:30 in regard to the litigation.

1:11:32 I will ask the board’s clerk to cause

1:11:34 reasonable public notice of the time and date

1:11:36 of this attorney client session

1:11:38 and the names of the persons attending to be published.

1:11:40 If the board approves, I will work with the board clerk

1:11:43 to coordinate dates for the attorney client session

1:11:45 working with our council’s availability

1:11:47 and provide notice of the meeting

1:11:48 inclusive of scheduling a court reporter.

1:11:51 As required by this statute,

1:11:52 only the following individuals may be present.

1:11:55 School board members, Katie Campbell,

1:11:56 Jennifer Jenkins, Matt Susan, Jean Trent, Megan Wright,

1:12:00 Superintendent Dr. Mark Rendell, Paul Gibbs,

1:12:02 General Counsel Howard Marks, Burr Foreman,

1:12:05 and Jennifer Bridges, Burr Foreman.

1:12:07 As required by statute, I will ask a court reporter

1:12:09 to record the session.

1:12:11 Their notes will be fully transcribed

1:12:12 and filed with the clerk of the school board.

1:12:15 Upon conclusion of any litigation and/or settlement

1:12:17 of all claims arising out of this case,

1:12:19 the transcript will be made public record.

1:12:22 - I recommend the board hold an attorney client session

1:12:25 pursuant to section 286.011 Florida statutes

1:12:28 to discuss strategy of pending litigation.

1:12:31 If there are no objections, I will instruct our attorney

1:12:33 to work with our board clerk and schedule

1:12:35 as soon as the matter may be heard.

1:12:37 Are there any objections?

1:12:39 - No, I just, I do have a question.

1:12:42 I don’t think we’ve had sessions about this case.

1:12:44 Maybe we have. - One, yeah, one.

1:12:47 - Right, sorry, I wasn’t finished with my thought yet.

1:12:52 What do we do when there’s a conflict of interest

1:12:55 for relationships of named parties?

1:12:59 - The board’s the board,

1:13:00 so the board gets to sit in the room.

1:13:03 - And that doesn’t have to be disclosed or?

1:13:06 - They’re the board, so.

1:13:07 It’s like Broward had one of the plaintiffs

1:13:09 in the Stoneman Douglas lawsuit was a board member

1:13:12 and they got to sit in the room, so.

1:13:14 - Correct, okay.

1:13:15 I wanted to say that out loud

1:13:17 ‘cause there’s been many questions about it.

1:13:19 - The board’s the board.

1:13:20 - Got it. - That’s the entity

1:13:21 that I have to work with.

1:13:22 - And that has to do with all litigation.

1:13:23 - Yep. - Okay, thanks.

1:13:26 - All right, any other, no objections?

1:13:29 All right, no further business.

1:13:31 This meeting is adjourned.

1:13:33 (gavel bangs)

1:13:34 (upbeat music)

1:14:31 (silence)
